Terms of Service
These Terms of Service ("Terms") govern your use of the Harbor Automation platform and its tools (the "Service"), provided by AC Tomkins & Company LLC ("AC Tomkins," "we," "us," or "our"). Harbor Automation is a brand of AC Tomkins & Company LLC. By accessing or using the Service, you agree to these Terms.
1. The Service
Harbor Automation provides web-based tools and automations. We may add, change, or remove features, and we may set limits on use, at our discretion.
2. Accounts and responsibilities
- You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
- You must provide accurate information and keep it up to date.
- You are responsible for the data you upload or connect and for ensuring you have the right to use it with the Service.
3. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- attempt to gain unauthorized access to the Service, other accounts, or its underlying systems;
- interfere with or disrupt the integrity or performance of the Service; or
- reverse engineer or attempt to extract the source code of the Service, except as permitted by law.
4. Third-party services
The Service integrates with third-party services (for example QuickBooks Online). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services and your authorization to connect them can be revoked by you at any time.
5. Intellectual property
The Service, including its software, design, and content, is owned by AC Tomkins and its licensors and is protected by applicable law. These Terms do not grant you any ownership of the Service. You retain ownership of the data you upload or connect.
6. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results obtained from it will be accurate.
7. Limitation of liability
To the maximum extent permitted by law, AC Tomkins will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.
9. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the effective date above; continued use of the Service means you accept the updated Terms.
